There will be a Public Meeting of the Mayor and Council of the Borough of Glen Rock on Wednesday, December 16, 2009, at 8:00 p.m. in the Council Chambers of the Municipal Building.

This meeting is called pursuant to the provisions of the Open Public Meeting Law. This Meeting was included in a list of meeting notices sent to the Bergen Record and advertised in said newspaper in January, posted on the bulletin board in the Municipal Building, and has remained continuously posted as the required notices under the Statue. In addition, a copy of this notice is and has been available to the public and is on file in the office of the Municipal Clerk.

In accordance with the New Jersey State Fire & Safety Code I call your attention to the lighted exit signs. In the event the alarm sounds, move in an orderly manner toward the exit nearest you and leave the building.

4. MOTIONS
Departmental Reports 

Council member Orseck (Parks & Recreation) – Basketball and indoor soccer have begun. The RAB recently held a question and answer period on turf fields. This Sunday at 1:00 p.m. there will be a formal dedication of the Thielke Arboretum. If any volunteers are interested in shoveling for senior citizens they are asked to contact the Recreation office. 

Council member Pazan (Finance) – The Finance meeting has been postponed due to the move. The Finance Committee will resume with meetings after the New Year.

Council member Arnao (Buildings & Grounds) – Borough offices will be relocating “back home”. Council member Arnao thanked Janeen McDonald for her many, many hours of dedication to the building.

Council member Biggs (Licenses & Franchises) – No report at this time.

Council member Surrago (Public Works) – The Central Business District has been adorned with winter decorations. Leaf pick-up will continue through the end of the year. The Mayor received a complimentary letter from a resident for the extra time Public Works took to determine the appropriate location for his shade trees due to power lines. 

Council member O’Hagan (Public Safety) – Residents are again reminded to drive slowly, particularly near and around our schools. The Council and BOE are pleased to announce a monthly event, called “Club 60” which will be directed at middle school students. Kudos to David Engle who was extremely instrumental in starting this program. Council member O’Hagan thanked Council member Arnao for all he has done for the Borough during his Council tenure.

BEING AN ORDINANCE COVERING FEES CHARGED BY

THE BOROUGH; TO PROVIDE FOR ADDITIONAL FEES FOR POLICE 
ADMINISTRATION SERVICES

Section I - Chapter 101 of the Revised General Ordinances of the Borough of Glen Rock 1971 as amended being an Ordinance entitled "Fees" is hereby amended by adding thereto the following: 

A. Chapter 101 of the Revised General Ordinance of the Borough of Glen Rock, 1971 as amended, entitled “Fees” is hereby amended by adding to Section 101-17 entitled “Police Administrative Fees’ a new subsection 3 to read as follows: 
“3. For purposes of discovery for court proceedings, copying of all reports: $5 for the first page and $1 for each additional page thereafter. This cost includes preparation of reports and associated documents. This also includes the cost of transmission either via mail, facsimile or electronically.”

Section II. VALIDITY-SEVERABILITY If the provisions of any section, subsection, paragraph, subdivision, or clause of this Ordinance shall be held invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this Ordinance but such judgment shall be confined in its operation to the section, paragraph, subdivision or clause directly involved in the controversy in which said judgment shall have been rendered.

Section III All Ordinances or parts of Ordinances inconsistent with the provisions hereof are hereby repealed. 

Section IV This Ordinance shall take effect upon passage as required by law.

Section I - Chapter 216 of the Revised General Ordinances of the Borough of Glen Rock 1971 as amended being an Ordinance entitled "Vehicles and Traffic" is hereby amended as to the following sections:

1. Section 216-39 entitled “Schedule XII: Handicapped Parking” is hereby amended by adding to Section B - On Street Parking, the following: 


Name of Street Side Location
Marinus Place North Beginning at a point 25 feet west of westerly curb line of Doremus Avenue and extending to a point 25 feet therefrom.”

AN ORDINANCE TO AMEND CHAPTER 230 OF THE
REVISED GENERAL ORDINANCES OF THE
BOROUGH OF GLEN ROCK, 1971 ENTITLED “ZONING”
BEING AN ORDINANCE ESTABLISHING A UNIFORM
SET OF ZONING REQUIREMENTS; TO MODIFY DEFINITIONS, CONDITIONS AND PARKING REQUIREMENTS

BE IT ORDAINED by the Borough Council, the Borough of Glen Rock, County of Bergen, State of New Jersey, as follows:
Section I - Chapter 230 of the Revised General Ordinances of the Borough of Glen Rock 1971, as amended, being an Ordinance entitled "Zoning" is hereby amended as to the following section(s):

1. Section 230-4 entitled “Definitions” is hereby amended by deleting “Garage, Private” in its entirety to be replaced with the following:

“Garage, Private. A detached accessory building or portion of a main building intended to be used for the storage of a passenger vehicle or vehicles and not more than one commercial vehicle of a rated capacity not exceeding 1-1/2 tons. Each garage shall not be smaller than 10' wide x 20' deep inside clear dimension and not any larger than 12' wide x 26' deep, not to exceed 36' in width. A carport or any similar structure not completely enclosed shall not be considered to be a garage.”

2. Section 230-4 entitled “Definitions”, is hereby amended by adding thereto the following new definitions:

“Restaurant: An establishment selling food and/or drink mainly consumed on premises with or without wait service.

Delicatessen: An establishment selling prepared food for offsite consumption only. Delicatessen will include take-out only establishments.

School: Any building or part thereof that is designated, constructed or used for education or instruction in any branch of knowledge.

Medical Office: An office for the medical treatment of humans or animals by a licensed or certified medical professional. Medical professionals shall include, but not limited to, physicians, dentists, chiropractors, therapists, veterinarians, etc.”

3. Section 230-14 entitled “Accessory buildings” is hereby amended as to the following subsection:

Subsection 230-14(A)(6) is amended by changing “four motor vehicles” to read “three motor vehicles”.

4. Section 230-18 entitled “Garages in residential districts” is hereby amended by deleting the last sentence in §230-18A which reads: “Garages for not more than a total capacity of four motor vehicles may be erected on a single lot.”

5. Section 230-33 entitled “Offsteet parking in residence districts” is hereby amended by deleting subsection “B” in its entirety to be replaced with the following:

“B. Such driveway shall not exceed 20 feet in width within 16' of the curbline, and may be widened to no more than 25' thereafter. However, if a residence has a 3 car garage, a driveway width of not more than 32' would be permitted from the entrance of the garage to 20' past the garage entrance, then transition to 25' wide (or 20' wide within 16' of the curbline) over the next 5' of length”.

6. Section 230-34 entitled “Offsteet parking in nonresidential districts” is hereby amended as to the following subsections:

A. Subsection A(7) entitled “Eating and drinking places” shall be deleted in its entirety and replaced with the following:

“A(7) Restaurants.

(a). Restaurants with wait service: one for each 100 sq. feet of gross floor area.

(b). Restaurants without wait service: one for each 150 square feet of gross floor area”.

B. Subsection A(15) entitled “Medical or dental offices” shall be deleted in its entirety and replaced with the following:

“A(15) Medical offices: one space per 100 square feet of gross floor area”.

C. Subsection A(25) entitled “Retail stores or service establishments and take-out food establishments for consumption off-site” shall be deleted in its entirety and replaced with the following:

“A(25)” Retail Stores and Delicatessens: one space per 200 square feet of gross floor area.”

D. Subsection A(26) entitled “Salons/barber shop/massage therapy/tanning salon and the like (personal care)” shall be deleted in its entirety and replaced with the following:

“A(26) - Salons/barber shop/massage therapy/tanning salon and similar personal care establishment: one space for every 75 square feet.

E. Subsection A(27) entitled “Schools” shall be amended by deleting paragraph (d) in its entirety and replaced with the following:

“A(27)(d) - An establishment having classes for academic, physical or social enrichment, either for adults or children, such as cooking, martial arts, fine arts, test preparation, etc., one space per 75 square feet of gross floor area.”

Section III. Jeanne Rey – 153 Winslow Terrace – Mrs. Rey thanked the Borough and Council for their continuous support of the Veteran’s.

Andrew Brown – Dean Street – Mr. Brown questioned why no one from the Borough was present at a recent Ridgewood meeting where it was voted to accept additional sewage at the Ridgewood Sewage Facility, which is located within Glen Rock. Ridgewood stands to benefit considerably from a monetary standpoint. Mayor van Keuren commented to the best of his knowledge the Council was not informed of such a meeting. Mrs. Benjamin stated she met with Ridgewood, on a separate subject, wherein they mentioned they were thinking about opening up their facility for additional sewage. Mrs. Benjamin was unaware a vote would be taken prior to discussions with the Council. Mrs. Benjamin added this is Ridgewood’s facility and property and is unsure where we would share in any kind of revenue. Mayor van Keuren stated it is his intent to have someone from Ridgewood attends a Borough Council meeting to explain the details.

John Koster – resident and author of newspaper article concerning Ridgewood Sewer Plant – Mr. Koster commented that the trucks transporting the sewage would be safe and odor-less. Mr. Koster also commented on Ridgewood Water’s rate increase – to which the Mayor and Council were aware of.

Anne Green – 131 Winslow Terrace – Mrs. Green expressed concern that the Ridgewood Sewage Plant has accepted a change in usage.

Mary Henninger – Thornbury Avenue – Mrs. Henninger commented on the new dates for work sessions and public meetings. Mrs. Henninger attended a recent screening of “The Greening of Southie”, a showing sponsored by the Environmental Commission. The movie showed how expensive “going green” can be. Mrs. Henninger questioned how a community can become sustainable, yet remain affordable. Mayor van Keuren stated the first priority would be affordability; however there are possibly some aspects that can be incorporated to achieve “more” sustainability. 

Andrew Brown – Dean Street – Mr. Brown confirmed the Council meetings will be on Tuesday and Thursday.
