There will be a Public Meeting of the Mayor and Council of the Borough of Glen Rock on Wednesday, December 10, 2008, at 8:00 p.m. in the Council Chambers of the Municipal Building.

1. CALL TO ORDER /ROLL CALL

This meeting is called pursuant to the provisions of the Open Public Meeting Law. This Meeting was included in a list of meeting notices sent to the Bergen Record and advertised in said newspaper in January, posted on the bulletin board in the Municipal Building, and has remained continuously posted as the required notices under the Statue. In addition, a copy of this notice is and has been available to the public and is on file in the office of the Municipal Clerk.

In accordance with the New Jersey State Fire & Safety Code I call your attention to the lighted exit signs. In the event the alarm sounds, move in an orderly manner toward the exit nearest you and leave the building.

2. FLAG SALUTE/ANNOUNCEMENTS 

Council member Surrago led the Council in the flag salute.

Mayor van Keuren recognized Bill Grundy, the Borough’s former Recreation Director. Bill’s contributions were noted and the following proclamation read:

WHEREAS, the recreation of our youth plays an important role in their development, health and well being; and

WHEREAS, Bill Grundy has been dedicated to creating a positive atmosphere in the programs and scheduling services he provided to the Borough of Glen Rock for the past 10 years, as both Director of our summer Shack Program and Recreation Director; and

WHEREAS, we as a Borough want to publicly recognize the strength, perseverance and determination he has shown over the past several months by honoring him at this meeting tonight.

NOW, THEREFORE, I, John van Keuren, Mayor along with the Council members present, as well as the staff of the Borough of Glen Rock, and the volunteers involved with our recreation programs, hereby honor Bill Grundy and declare Wednesday, December 10, 2008 as Bill Grundy Day in Glen Rock, in tribute to 10 years of dedicated service to the Borough of Glen Rock.


3. CONSENT AGENDA

There will be no separate discussion on these items unless a Council member(s) so request it, in which case the item(s) will be removed from the Consent Agenda and considered in its normal sequence on the agenda. 3. Resolution Requesting Approval of Outside Employment of Off Duty Officers

Resolution: Requesting approval of the Director of the Division of Local Government Services to Establish a Dedicated Trust by Rider for the Outside Employment of Off Duty Police Officers Pursuant to N.J.S.A. 40A:4-39

WHEREAS, permission is required of the Director of the Division of Local Government Services for a dedication by rider of revenues received by a municipality when the revenue is not subject to reasonable accurate estimates in advance, and

WHEREAS, N.J.S.A. 4OA:4-39 allows municipalities to receive amounts for costs incurred for Outside Employment of Off Duty Police Officers, and

WHEREAS, N.J.S.A. 4OA:4-39 provides that the Director of the Division of Local Government Services may approve expenditure of monies by dedication by rider,

NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Glen Rock, County of Bergen, State of New Jersey as follows:

1. The Borough Council hereby notifies the Director of the Division of Local Government Services to pay expenditures for Outside Employment of Police Officers as per N.J.S.A. 40A:4-39.

2. The municipal clerk of the Borough of Glen Rock is hereby directed to forward two certified copies of the resolution to the Director of the Division of Local Government Services.

4. Resolution Canceling Tax Refunds or Overpayments

RESOLUTION TO CANCEL TAX REFUND OR OVER PAYMENTS

WHEREAS, N.J.S.A. 40A:5-17 allows for the cancellation of property tax refunds or delinquent amounts in the amount of less than $10.00; and,

WHEREAS, the governing body authorizes the Tax Collector to cancel the following refund: 4th quarter 2006 $.01 block 31 lot 21, and overpayment 3rd quarter 2008 block 121 lot 11 $.04 

NOW, THERFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Glen Rock, County of Bergen, State of New Jersey, hereby authorize the Tax Collector to cancel said tax amounts.

5. Resolution for Chapter 159 for Body Armor

Approval of items of Revenue and Appropriation
NJS 40A:4-87

Whereas, NJS 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount was not determined at the time of the adoption of the budget; and

WHEREAS, the Director may also approve the insertion of an item of appropriation for equal amount,

NOW, THEREFORE BE IT RESOLVED, that the Mayor and Council of the Borough of Glen Rock in the County of Bergen, New Jersey, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2008 in the amount of $2,045.29, which is now available from the State of New Jersey Division of Criminal Justice in the amount of $2,045.29.

BE IT FURTHER RESOLVED that the like sum of $2,045.29 is hereby appropriated under the caption of 2008 Body Armor; and

BE IT FURTHER RESOLVED that the above is the result of funds from the State of New Jersey Division of Criminal Justice in the amount of $2,045.29

ORDINANCE NO. 1580

AN ORDINANCE TO AMEND CHAPTER 101 OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF GLEN ROCK - 1971 AS AMENDED ENTITLED "FEES” BEING AN ORDINANCE COVERING FEES CHARGED BY VARIOUS AGENCIES, BUREAUS AND DEPARTMENTS WITHIN THE BOROUGH; TO AMEND PARKING FEES 

BE IT ORDAINED by the Borough Council, the Borough of Glen Rock, County of
Bergen, State of New Jersey, as follows:

Section I - Chapter 101 of the Revised General Ordinances of the Borough of Glen Rock 1971 as amended being an Ordinance entitled "Fees" is hereby amended as to the following section(s):

1. Subsection 101-14 entitled “Parking Fees” is hereby amended as to the following subsections:
i. Subsection (b) entitled “Meter Parking” is hereby deleted in its entirety and replaced with the following:
“b. Meter parking: $6.00 per day (effective 1/01 /09”.
ii. Subsection ( c ) entitled “Resident Commuter Parking” is hereby deleted in its entirety and replaced with the following:
“c. i. Resident Commuter Parking: $145 per annum”.
ii. Discount Rate: Residents providing proof that they either own or lease a hybrid or alternate fuel vehicle - $130 per annum 

Section II. VALIDITY-SEVERABILITY If the provisions of any section, subsection, paragraph, subdivision, or clause of this Ordinance shall be held invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this Ordinance but such judgment shall be confined in its operation to the section, paragraph, subdivision or clause directly involved in the controversy in which said judgment shall have been rendered.

Section III All Ordinances or parts of Ordinances inconsistent with the provisions hereof are hereby repealed. 

Section IV This Ordinance shall take effect upon passage as required by law.

Diane Herrlett – 5 Franklin Place – Mrs. Herrlett asked the Council to consider a “booklet” of passes for the resident who may not use the shuttle bus every day, perhaps something for those who may only use the bus once or twice a month.
