2. FLAG SALUTE/ANNOUNCEMENTS 

This meeting is called pursuant to the provisions of the Open Public Meeting Law. This Meeting was included in a list of meeting notices sent to the Bergen Record and advertised in said newspaper in January, posted on the bulletin board in the Municipal Building, and has remained continuously posted as the required notices under the Statue. In addition, a copy of this notice is and has been available to the public and is on file in the office of the Municipal Clerk.

In accordance with the New Jersey State Fire & Safety Code I call your attention to the lighted exit signs. In the event the alarm sounds, move in an orderly manner toward the exit nearest you and leave the building. 

Eagle Scout Scott Benjamin Scheraga led the Council in the flag salute. Scott’s Eagle project was to paint maltese crosses on the road to indicate fire hydrant locations. Mayor van Keuren thanked all of the Borough’s Eagle Scouts and Gold Award recipients for their achievement and contribution to the borough.

Council member Knapp recognized High School Principal McCarthy and Deputy Mayor Roetters (and visitors) from Moers, Germany. Mayor van Keuren read the following proclamation honoring the relationship with the City of Moers, Germany. 

A Proclamation

WHEREAS, whenever the students and residents of one area visit those of another, both groups derive lasting benefits. The resulting exchange of ideas, face to face, educates and enriches both groups, and creates new friends; and

WHEREAS, students and residents of the city of Moers, in Germany and the borough of Glen Rock, in the United States have made exchange visits for several years under the auspices of the school systems of the two towns; and 

WHEREAS, as we in Glen Rock send our students to Moers they carry more than just our good wishes to each of you in Moers. They also carry our belief that as we exchange friendliness on an individual basis we contribute in a very significant way to the development of friendship and understanding on a broader scale. 

Deputy Mayor Roetters, when you return to Moers we will send you back with something of ourselves, and we, too, will be better and wiser and more appreciative of what separates and what links us because of what you and your colleagues and your young representatives have brought here. And you Principal McCarthy, under your genial, caring guidance this exchange of students has become, for the students and residents of Glen Rock, a truly unique lesson in building the understanding that distance apart can bring us closer. 

NOW, THEREFORE, to recognize both the value of this arrangement and the esteem in which we hold you, its architects and overseers, I declare that Hans-Gerd Roetters of Moers, Germany and James McCarthy of Ramsey, New Jersey be designated honorary citizens of the Borough of Glen Rock

BE IT ORDAINED by the Borough Council, the Borough of Glen Rock, County of

ENTITLED "LICENSING/GENERAL"; BEING AN ORDINANCE ESTABLISHING A UNIFORM SET OF PROCEDURES FOR
ADMINISTERING THE ISSUANCE OF LICENSES WITHIN THE BOROUGH; TO PROVIDE FOR 
GARAGE SALES WITHIN THE BOROUGH

BE IT ORDAINED By the Mayor and Council of the Borough of Glen Rock, County of Bergen, State of New Jersey, as follows:

Section 1. Chapter 133 of the Revised General Ordinances of the Borough of Glen Rock, 1971, as amended, being an Ordinance entitled "Licensing/General", is hereby amended as follows:
1. There is added thereto a new Section, Article III, Garage Sales, to read as follows:
"133. Definitions

133.29 Definitions 

Garage Sale shall mean and include all sales entitled "garage sale", "lawn sale", "attic sale", "rummage sale", "flea market sale", or any similar casual sale of tangible personal property which is advertised by any means whereby the public at large is or can be made aware of the sale.

Goods shall mean to include any goods, warehouse merchandise or other property capable of being the object of the sale regulated hereunder. Goods acquired solely for the purpose of resale are not allowed. A person may not be in the business of selling such property from his/her home.

Person shall mean and include individuals, partnerships, voluntary associations and corporations.

133.30 Permits and Fees. It shall be unlawful for any person to conduct a garage sale in the Borough without first registering with the Police Department. Permits may be obtained in person or online. If submitted online, the permit should be filled out before sending to the Police Department. A second copy of the permit should be printed and posted at the location of the sale and be clearly visible from the street.

133.31 Fee. The fee, if any, for such license shall be as set forth by the Resolution of the Mayor and Council.

133.32 Number and Hours. Each person may register four (4) times within a twelve month period. (two the first six months (January 1 to June 30 and two the second six months – July 1 to December 31) and the registration shall be valid for no more than three consecutive calendar days. The garage sale may take place only during the hours of 9:00 a.m. and 6:00 p.m.

133.33 Persons or Sales Excepted. The provisions of this ordinance shall not apply to or affect the following persons or sales:

a. Persons selling goods pursuant to an Order or process of a court of competent jurisdiction;

b. Persons acting in accordance with their powers and duties as a public official; or

c. Any person selling or advertising a sale of items of personal property which are specifically named or described in the advertisement in which separate items do not exceed five (5).

133.34 Penalty. Any person or corporation conducting any such sale without being properly registered therefore, or who shall violate any of the other terms and regulations of this ordinance, shall first receive a warning from the Police Department after the fifth garage sale. Thereafter, any person who is convicted of a violation of any provision of this article shall be subject to a fine of not less than $100.00, no more than $500.00

Section 2. Validity-Severability.
If the provisions of any section, subsection, paragraph, subdivision, or clause of this Ordinance shall be adjudged invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this Ordinance, but such judgment shall be confined in its operation to the section, paragraph, subdivision or clause directly involved in the controversy in which said judgment shall have been rendered.

Section 3. All Ordinances or parts of Ordinances inconsistent with the provision hereof are hereby repealed.

Section 4. This Ordinance shall take effect upon passage and publication as required by law.

BE IT ORDAINED by the Borough Council, the Borough of Glen Rock, County of Bergen, State of New Jersey, as follows:

Section I - Chapter 150 of the Revised General Ordinances of the Borough of Glen Rock 1971, as amended, entitled "Parking,” is hereby amended as follows:

A. There is added thereto a new Section 150-11 entitled “Dedicated Resident-Nonresident Parking Area” to read as follows: 

“150-11 Dedicated Resident-Nonresident Parking Area.

A. Parking in Borough areas/lots as noted on Schedule “A” is restricted to vehicles owned by individuals who have been awarded, by bid, the right to lease said parking space, on an annual basis, from the Borough of Glen Rock (the “tenant”). The tenant shall at all times display a Borough-issued identification placard. 

B. The effective period of the form of identification shall be from January 1 to December 31. The Police Department is authorized to issue the identification placard to the tenant. The Police Department is also authorized to reissue, within the effective period, replacement identification placards to a tenant upon reasonable proof that the identification placard has been lost or destroyed through no intentional act of the tenant. The cost of the replacement identification placard shall be in the amount of $50.00.

C. Fees. Pursuant to the successful annual bid.

D. Permit Transfer. The permits are non-transferable by the tenant.

E. Permitted Use of parking space - The tenant may utilize the parking space Monday through Friday from 6:00 a.m. through 12:00 p.m. No overnight or weekend parking is permitted.

F. Passenger Vehicles - The tenant shall only be permitted to park a passenger vehicle in the parking space. Commercial vehicles are prohibited.

G. Violations. For violation of any provision of this section, the penalty, upon conviction shall be as follows: 

1. An individual shall, upon conviction, be subject to the following fines:

a. Any individual who shall illegally park in a dedicated parking space shall have his/her vehicle towed, that their sole cost and expense, and shall be punished by a fine, upon conviction, no less than $100 nor greater than $250, per offense.

b. Any individual who shall fail to display a parking permit placard shall be punished by a fine, upon conviction, not less than $50, nor greater than $500, per offense. 

2. Separate Violations - each violation of any of the provisions of this Section and each day that each such violation shall continue, shall be deemed to be as a separate and distinct offense.”



Section II. SECTION 1. That there is hereby established salary and wages for the classification of certain employees herein below set forth:

SECTION 4. The amount to be paid to each officer or employee within the salary and wage range shall be fixed from time to time by resolution of the Mayor and Council.

SECTION 5. In addition to the salary ranges indicated above, longevity pay will be given to full-time Police Employees as specified in the contract. 

SECTION 6. The provisions of any ordinance or ordinances inconsistent with the provisions hereof are hereby expressly repealed.

SECTION 7. Where labor contract prevails, terms and conditions of the contract shall supersede this ordinance.

SECTION 8. This ordinance shall take effect retroactive to January 1, 2007 upon passage and publication as required by law.

AN ORDINANCE TO AUTHORIZE THE LEASE
OF REAL PROPERTY BY THE BOROUGH OF GLEN ROCK
COUNTY OF BERGEN, STATE OF NEW JERSEY

BE IT ORDAINED by the Borough Council, the Borough of Glen Rock, County of Bergen, State of New Jersey, as follows:

WHEREAS, Borough Ordinance §150-6 establishes certain parking districts with Borough owned parking lots; 

WHEREAS, Borough Ordinance §150-11 establishes thirty-six (36) dedicated parking spaces available for an annual lease to residents and nonresidents of the Borough of Glen Rock; and
WHEREAS, the Borough of Glen Rock, pursuant to N.J.S.A. 40A:12-14(a) desires to authorize, for lease, the dedicated parking spaces for a period of one (1) year, subject to the terms and conditions outlined herein:

Now, therefore, be it ordained by the Borough Council, the Borough of Glen Rock, County of Bergen, State of New Jersey, as follows:

Section I. The Borough of Glen Rock is hereby authorized to lease thirty-six (36) parking spaces, specifically identified on the parking map of the Borough of Glen Rock, Bergen County, New Jersey dated September 2007 (Borough Ordinance §150-6) and to enter into a lease agreement in accordance with N.J.S.A. 40A:12-14(a), subject to the following bid conditions:

a. The minimum sealed bid shall be $1,500.00 per annum, to be submitted with a certified bank or cashiers check payable to the Borough of Glen Rock in the amount of 10% of one year rent as bid security. There shall be a rent security equal to two (2) months rental payable upon execution of a lease agreement.
b. The Borough shall be responsible for snow removal and maintenance of the parking area, except for damage caused by the tenant (bidder).
c. The Borough reserves the right to reject any and all bids. 
d. The Tenant (bidder) shall maintain, and name the Borough as additional insured, minimum liability insurance in the amount of $100,000 bodily injury Liability for one person; and $300,000.00 bodily injury liability for two or more people.
e. Only one household member, either resident or nonresident, may rent a parking space.
f. Preference shall be given to Borough residents in case of a tie.
g. Rent payment shall be made, in advance, on a semi-annual basis. Failure to make payment within ten (10) days of the due date shall be an event of default;
h. Each vehicle must affix a Borough issued placard.
i. Each individual must conform to the requirements set forth in Borough Code §150-11.

3. CONSENT AGENDA

All items listed are considered to be routine and non-controversial by the Borough Council and will be approved by one motion. There will be no separate discussion on these items unless a Council member(s) so request it, in which case the item(s) will be removed from the Consent Agenda and considered in its normal sequence on the agenda. The one motion signifies adoption of all resolutions, received and filed letters, correspondence, reports and approval of applications and minutes.

Mayor van Keuren asked if anyone in the audience had questions concerning the ordinances that were just introduced and passed.

WHEREAS, Stantec Consulting Services, has signed off on the plans and recommends a that the bond be returned; and

4. Resolution Award Bid for Speed Humps (Traffic Logix)

RESOLUTION AWARDING BID FOR TO PURCHASE SPEED (TABLE) HUMPS

WHEREAS, the Borough of Glen Rock received bids on October 10, 2007 for a Speed (Table) Humps, and the lowest responsible bid was received from Traffic Logix, of Spring Valley, New York, a piece of equipment budgeted in the 2007capital budget; and

WHEREAS, Stantec Consulting has recommended the low bid, for a total of $26,368.00; now therefore

BE IT RESOLVED, by the Borough Council of Glen Rock, that the bid for the purchase of Four (4) Speed Humps is hereby awarded to Traffic Logix for an amount not to exceed $26,368.00., subject to certification of funds by the CFO.

5. Resolution Authorizing the Borough to Bid Parking Spaces at Main Line

RESOLUTION AUTHORIZING BIDDING OF PARKING SPACE LEASE

WHEREAS, the Governing Body of the Borough of Glen Rock has authorized Ordinance §150-11 establishing thirty-six (36) dedicated parking spaces available for an annual lease to residents and nonresidents of the Borough of Glen Rock; and

WHEREAS, the Borough of Glen Rock, pursuant to N.J.S.A. 40A:12-14(a) desires to authorize, for lease, the dedicated parking spaces for a period of one (1) year, subject to the terms and conditions in ordinance;

NOW THEREFORE BE IT, RESOLVED by the Governing Body of the Borough of Glen Rock that pursuant to N.J.S.A. 40A:12-14(a) the Borough Administrator is authorized to make all appropriate arrangements to advertise for bid 36 parking spaces located in the Main Line train station consistent to the provision of Ordinance §150-11.

6. MEETING OPEN TO THE PUBLIC: (Before speaking at the meeting, each person must state their name and address. 5 minute limit)

Robin Scheraga – 24 Rockingham Place – Mrs. Scheraga thanked the Council for their continuous support of the Scouts and numerous Eagle Projects. Mrs. Scheraga suggested a Mayor-appointed liaison to act as coordinator for the various Eagle, Gold and volunteer projects requested throughout the year. Mayor van Keuren asked Mrs. Scheraga to explain Scott’s robotic interest. Scott attends the computer sciences school at Bergen Academy with a heavy interest in robotics. Scott currently has an internship with a robotic Dr. at Valley Hospital working in pancreatic surgeries. 

Leslie Kameny - 33 Beech Road – Ms. Kameny previously proposed the Borough consider adopting a tree ordinance. Ms. Kameny presented additional information to the Council. Mayor van Keuren stated this subject is on the agenda for the next work session. 

Mary Henninger – Thornbury Avenue – Mrs. Henninger asked for an update on the shuttle bus. Mayor van Keuren stated the bus has arrived and is being used. Mrs. Henninger also asked for an update on Channel 77. Council member Arnao stated he has been in contact with Cablevision and the company that manufacturers our equipment. Unfortunately, Channel 77 is still not operating properly; however it is an issue that is being discussed daily for resolution. Mrs. Henninger also asked for an update on the “water blending” meeting with Ridgewood Water. Mayor van Keuren stated a representative from Ridgewood Water explained why the blending must occur and which areas will receive the most United Water. Ridgewood Water assured us that the quality of water being received from United Water meets all standards, adding that United Water performs more tests that Ridgewood Water.
