WHEREAS, a Bergen County Community Development grant of $52,000 for Doremus Avenue Park ADA in the municipality of Glen Rock, and
WHEREAS, pursuant to the State Inter-local Services Act, Community Development funds may not be spent in a municipality without authorization by the Governing Body, and
WHEREAS, the aforesaid project is in the best interest of the people of Glen Rock, and
WHEREAS, this resolution does not obligate the financial resources of the municipality and is intended solely to expedite expenditure of the aforesaid CD funds.
NOW, THEREFORE, BE IT RESOLVED that the Governing Body of Glen Rock hereby confirm endorsement of the aforesaid project, and

11. Resolution for Professional Services Agreement (R. Wiss, Labor Attorney)

RESOLUTION AUTHORIZING PROFESSIONAL SERVICES CONTRACT
WHEREAS, the Borough of Glen Rock is in need of recurrent and regular need for professional labor and employment legal services for the period of September 24, 2008 through December 31, 2008; and
WHEREAS, Raymond R. Wiss, Esq., of the firm of Wiss & Bouregy, P.C. has submitted a proposal dated September 24, 2008, setting forth the anticipated hourly charges/costs to be assessed to the Borough of Glen Rock for the 2008 contract term; and
WHEREAS, pursuant to the provisions of the New Jersey Campaign Contribution and Expenditures Reporting Act, specifically N.J.S.A. 19:44A-205, the Borough has determined and certified in writing that the value of the services may exceed $17,500.00; and
WHEREAS, Raymond R. Wiss, Esq., of the firm of Wiss & Bouregy, P.C. has completed and submitted a Business Entity Disclosure Certification which certifies that Raymond R. Wiss, Esq., and the firm of Wiss & Bouregy, P.C. has not made any reportable contributions to a political or candidate committee in the Borough of Glen Rock, in the previous one year and that the contract will prohibit Raymond R. Wiss, Esq., and the firm of Wiss & Bouregy, P.C. from making any reportable contributions through the term of the contract; and
WHEREAS, legal services are a professional service exempt from public bidding requirements, but notice of this resolution must be published in a legal newspaper as required by the Local Public Contracts Law; and
WHEREFORE, the Chief Financial Officer has provided the Governing Body with Certification of the availability of funds requirements.
NOW THEREFOR BE IT, RESOLVED, by the Borough Council of Glen Rock, that the Mayor or the Borough Administrator is hereby authorized to enter into a contract with Raymond R. Wiss, Esq., of the firm of Wiss & Bouregy, P.C. as declared herein; with a total amount of the services not to exceed the sum of $5,000 without further authorization of the Governing Body, and be it further
RESOLVED, that the Business Disclosure Entity Certification and the Determination of Value be placed on file with this Resolution; and be it further
RESOLVED, that the Borough Clerk shall cause to be published, notification of the award of the Professional Services Contract as required by the Local Public Contracts Law.
Political Contribution Disclosure: This Contract has been awarded to Raymond R. Wiss, Esq., of the firm of Wiss & Bouregy, P.C. based on the merits and abilities of Raymond R. Wiss, Esq., to provide the goods or services as described herein. This contract was not awarded through a “fair and open process” pursuant to N.J.S.A. 19:44A-20.4 et seq. As such, the undersigned does hereby attest that Raymond R. Wiss, Esq., of the firm of Wiss & Bouregy, P.C., its subsidiaries, assigns, or principals controlling in excess of 10% of the company has neither made a contribution, that is reportable pursuant to the Election Law Enforcement Commission pursuant to N.J.S.A., 19:44A-8 or 19:44A-16, in the one (1) year period preceding the award of the contract that would, pursuant to P.L. 2004, c.19, affect is eligibility to perform this contract, nor will it make a reportable contribution during the term of the Contract to any political party committee in the Borough of Glen Rock if a member of that political party is serving in an elective public office of the Borough of Glen Rock when the contract is awarded, or to any candidate committee of any person serving in an elective public office of that the Borough of Glen Rock when the contract is awarded.

12. Resolution Approving Employee Handbook

WHEREAS, the Mayor and Council has determined that there is a need to amend the existing personnel policies and procedures.
NOW, THEREBY, BE IT RESOLVED by the Mayor and Council that the Personnel Policies and Procedures Manual/Handbook, is hereby amended as follows:
1. Chapter II entitled “Employment,” Section 8 entitled “Drugs and Alcohol Policy” is hereby deleted in it’s entirety and replaced with the following:
“Section 8. Drugs and Alcohol Policy.
The Borough recognizes that the possession or use of unlawful drugs and the abuse of alcohol pose a threat to the health and safety of all employees. Any employee who is observed by a supervisor or department head to be intoxicated or under the influence of alcohol or drugs during working hours or is under reasonable suspicion of same shall be immediately tested and is subject to discipline up to and including termination. The supervisor or Department Head will immediately report any reasonable suspicions to the Borough Administrator.
An employee will be required to submit to alcohol, drug or controlled substance testing when the employee’s work performance causes a reasonable suspicion that employee is impaired due to current intoxication, drug or controlled substance use, or in cases where employment has been conditioned upon remaining alcohol, drug, or controlled dangerous substance free following treatment. Refusal to submit to testing when requested may result in immediate disciplinary action, including termination. Supervisors or Department heads that observe behavior constituting reasonable suspicion are required to institute testing and do not have the option of sending the employee home as an alternative.
The manufacturing, distribution, dispensation, possession, and use of alcohol or unlawful drugs on Borough premises or during work hours by employees is strictly prohibited.
Employees must notify their supervisor within five (5) days of conviction for a drug or alcohol related.
Employees who are required to maintain a Commercial Driver’s License (“CDL”) are subject to random drug testing as required by the federal government.
Employees using prescription drugs that may affect job performance or safety must notify the Borough Administrator who is required to maintain the confidentiality of any information regarding an employee’s medical condition in accordance with the Health Insurance Portability and Protection Act. Borough personnel who hold a Commercial Driver’s License (“CDL”) are subject to the provisions of the Commercial Driver’s Licenses Drug and Alcohol Testing Policy. (A program to assist employees who may have a drug/alcohol problem is provided through the Borough’s Employee Assistance Program.)
No prescription drug should be used by any person other than the individual to whom it is prescribed. Such substances or non-prescription (over-the-counter) drugs should be used only as prescribed or indicated. Employees are prohibited from consuming prescription drugs that are not prescribed in their name on Borough property or while performing Borough business. Soliciting or distributing prescription drugs for or to other employees is also strictly prohibited.
2. Chapter II entitled “Employment,” Section 19 entitled “Employment Procedures- Pre-employment Interview and Physical examination and Background Checks” is hereby amended by adding thereto the following new subsections:
“E. Job Offers
The final decision will be made by the Mayor and Council and Borough Administrator after all references and other information has been verified. Every effort shall be made to offer reasonable accommodations to known physical and mental limitations of all applicants with disabilities, provided that the individual is otherwise qualified to safely perform the essential functions of the job and also provided that the accommodation does not impose an unreasonable hardship on the Borough. The employment offer must be made in a letter to the candidate outlining all terms and conditions of the offer. The letter will also establish a deadline for acceptance.
F. Acceptances and Rejections
If the first offer is rejected, the Mayor and Council and Borough Administrator will decide to hire another candidate or re-open the position. Once a candidate accepts the employment offer, all other candidates will be notified in writing that they were not accepted for the position.
G. Record Retention
All applications, notes made during interviews and reference checks, job offers and other documents created during hiring process must be returned to the Personnel Administrator title. Documents related to the successful candidate will be placed in the employee’s official personnel file except medical records including physical examinations must be maintained in a separate file. All records documents related to other candidates must be retained for at least one year. Records and documents created during the hiring process are confidential and must be retained in a locked cabinet.”
3. Chapter II entitled “Employment,” Section 19 entitled “Employment Procedures- Pre-employment Interview and Physical examination and Background Checks”, subscection “Background Checks and Procedures for Candidates, Employees and Volunteers” is hereby amended by deleting the section entitled “Appeal Process” to be replaced with the following:
“Appeal Process: The Appeals Committee will be comprised of a (Borough Administrator, Police Chief or other designated superior officer, and Personnel Administrator.
Once a candidate, employee or volunteer has been notified of a disqualifying conviction, the employee has 14 calendar days to file a Notice of Appeal with the Borough of Glen Rock. Such Notice of Appeal must be sent in writing to the Personnel Administrator. The Notice of Appeal shall include a Notice of Rehabilitation and/or Notice that the information is inaccurate or incorrect pursuant to NJAC 13:59-1.6.
During the 14-day period listed above, and until the issuance of the decision of the Appeals Committee, and employee will be on a suspension with pay, pending the outcome of the Notice of Appeal.
In making a determination on the appeal, the following information will be considered:
1. The nature and responsibility of the position which the convicted individual would hold, has held, or currently holds, as the case may be.
2. The nature and seriousness of the crime or offense.
3. The circumstances under which the crime or offense occurred.
4. The date of the crime or offense.
5. The age of the individual when the crime or offense was committed.
6. Whether the crime or offense was an isolated or a repeated incident.
7. Any social conditions which may have contributed to the commission of the crime or offense.
8. Any evidence of rehabilitation, including good conduct in prison or in the community, counseling or psychiatric treatment received.
9. Acquisition of additional academic or vocational schooling, successful participation in correctional work-release programs, or the recommendation of those who have had the individual under their supervision.
The Borough of Glen Rock will issue a written determination on the employee’s appeal of their disqualifying conviction, setting forth the reasons for the determination.”
4. Chapter II entitled “Employment,” is amended by adding thereto new Sections entitled “Open Public Meetings Act Procedure concerning Personnel Matters”, “Processing and Orientation of New Employees Procedure”, “Initial Employment Period Procedure”, and “Educational and Experiential Qualifications “ to read as follows:
“Open Public Meetings Act Procedure concerning Personnel Matters:
Discussions by the governing body or any body of the Borough concerning appointment, termination, terms and conditions of employment, performance evaluation, promotion or discipline of any current or prospective officer or employee shall be in closed session unless the individual requests in writing that the discussion be held in open session. Such request must be granted. Prior to the discussion by the governing body or any body of the Borough concerning such matters, the Clerk shall notify the affected person(s) of the meeting date, time and place, the matters to be discussed and the person’s right to request that the discussion occur in open session. In the event more than one person is affected by the discussion and one of the affected persons does not request that the discussion be in open session, then the discussion shall be in closed session. If the individual(s) does not request that the discussion be held in open session, the governing body or other body of the Borough may at its sole discretion invite the affected individual(s) to attend the applicable portion of the closed session.
Processing and Orientation of New Employees Procedure:
All new regular full-time and regular part-time employees will be scheduled to meet with the Borough Administrator, Personnel Administrator and Department Head on their first day for a general orientation. Copies of all forms and acknowledgments must be returned to the Personnel Administrator for inclusion in the employee’s official personnel file. The orientation will include:
A tour of the appropriate facilities to acquaint the new employee with overall operations as they relate to the specific position;
The completion of all pertinent personnel, payroll, insurance and pension forms;
A review of the Employee Handbook and acknowledgment of receipt;
A review of the Personnel Policies and Procedures Manual if the employee is a manager or supervisor and acknowledgment of receipt;
The Employee Complaint Policy letter and acknowledgment;
A safety orientation and acknowledgment; and
Arrangements for the new employee to complete required PEOSHA safety training.
Initial Employment Period Procedure:
Except where State requirements direct otherwise, new employees (or present employees transferring to new positions) will be hired subject to an initial employment period of not less than one (1) month or more than six (6) months, as determined by the Borough Administrator. During this initial employment period, the new employee or transferee will be provided with training and guidance from the supervisor. At the end of the initial employment period, the supervisor will conduct an employee evaluation – see Performance Evaluation Procedure. New employees may be discharged at any time during this period if the Borough Administrator concludes that the employee is not progressing or performing satisfactorily. Under appropriate circumstances, the Borough Administrator may extend the initial employment period. (Newly hired employees are not eligible for payment of paid time off except holidays until the successful completion of their initial employment period.)
Nothing in the procedure set forth in this section shall alter the Borough’s employment at will policy. Employment with the Borough is at will and may be terminated at any time with or without cause or notice by the Borough or the employee.
Educational and Experiential Qualifications
Employees of the Borough of Glen Rock must have the educational and experiential qualifications for the position they hold or for the promotion they seek. In addition, employees must hold educational degrees or certifications as required by municipal, county, or state law for the positions they seek, as well as job related experience to support their appointment.”
5. Chapter III entitled “Benefits,” Section 3 entitled “Sick Time” is amended by adding thereto the following:
“An employee with 10 years of service to the Borough shall be entitled to one- quarter of accumulated sick leave not to exceed 60 days at time of separation due to voluntary resignation.”
6. Chapter III entitled “Benefits,” Section 5 entitled “Medical Benefit Plan” is deleted in its entirety and replaced with the following:
“Section 5. Medical Benefit Plan.
Participation in the State Health Benefits Plan (SHBP), and rules on enrollment and benefits options are available from the Benefits Coordinator. Employees working 25 or more hours per week are eligible for health benefits. New employees should enroll immediately as there is a several month waiting period before medical health benefits become effective.
Employees who retire with 25 years of service qualify for paid health benefits for retirees and prospective retirees should consult the Benefits Coordinator for details.”
7. Chapter III entitled “Benefits,” Section 8 entitled “Worker’s Compensation” is deleted in its entirety and replaced with the following:
“Section 8. Worker's Compensation
See Chapter II – Employment, Section 6.
Procedure:
A. Any time an accident or injury occurs while on the job, an employee shall report the incident to his/her supervisor immediately, no matter how small the injury. In addition, an accident report is to be completed and given to the Department Head and/or Borough Clerk immediately after injury.
B. Department Head will transmit the injury form to the Borough Clerk within twenty four (24) hours.
C. Compensation for time lost from the job due to an on-the-job injury or job related illness will be handled as follows:
1. Employee will receive normal salary from the Borough of Glen Rock.
2. Employer will receive a compensation check from the insurance company.
D. Continuation of benefits while on Worker’s Compensation will be in accordance with N.J. Division of Pensions Employee Benefits Manual.”
8. Chapter III entitled “Benefits,” Section 8 entitled “Dental Insurance” is deleted in its entirety and replaced with the following:
“Section 11. Dental Insurance
The Borough of Glen Rock provides dental insurance coverage for all full- time employees, who must pay 15% of the costs for single coverage benefits through payroll deduction. Employees with dependent dental coverage will pay $45 per month for dependent coverage.
Employees will be eligible for participation in the dental program following the completion of three (3) months continuous service with the Borough of Glen Rock.”
9. Chapter IV entitled “Leaves of Absences” is amended by adding thereto Section 12 entitled “New Jersey Family Leave Act” to read as follows:
“Section 8. New Jersey Family Leave Act
The employee must be employed for at least twelve (12) months for the employer, and must have worked 1,000 base hours in the preceding twelve (12) months.
This will be funded by the employee 100% through a payroll deduction of approximately $0.64 a week.
The New Jersey Family Leave Act permits leave to be taken for:
A. The care of a newly born or adopted child, as long as leave begins within
one year of the date the child is born to or placed with the employee; or
The care of a parent, child under 18, spouse or partner in a civil union who has a serious health condition or requiring in-patient care, continuing medical treatment or medical super-vision. The Family Leave Act considers parents to be: in-laws, step-parents, foster parents, adoptive parents, or others having a parent-child relationship with an employee.
Permits up to six (6) weeks of paid leave for workers to provide care for a sick family member or care for a newborn or newly adopted child.
Allows employee to receive no more than two-thirds of their weekly pay, up to a maximum weekly benefit of $524.00 for 2008.
Employee must provide thirty (30) days notice prior to leave if leave is sought to be with a child after birth or adoption. An employee must provide the employer with prior notice of the leave in a reasonable and practicable manner if the leave is to care for a family member with a serious health condition, unless an emergency or other unforeseen circumstance precludes prior notice.”
10. All section numbers and table of contents within the Employee Handbook shall be renumbered accordingly; and be it further
RESOLVED that this amendment to the personnel policies and procedures shall apply to all Borough officials, appointees, employees, volunteers and independent contractors. In the event there is a conflict between these rules and any collective bargaining agreement, personnel services contract or Federal or State law, the terms and conditions of that contract or law shall prevail. In all other cases, these policies and procedures shall prevail.

4. MOTIONS
Departmental Reports
Council member Arnao (Licenses & Franchises) – Commented he had hoped to receive and install the television equipment; however there may have been another “snag”.
Council member Orseck (Parks & Recreation) – Soccer and Baseball registration for the fall was held with the number of participants slightly down. Football is in full swing. Approximately thirty resumes have been received for a full-time Recreation Director. One of the areas of focus for this position will be working with the Senior Citizens to provide additional activities for them. Pool statistics showed 443 fewer individual memberships for 2008; however there were 18 more senior citizen memberships. There were 4,146 total memberships for 2008. Council member O’Hagan has graciously agreed to monitor the field conditions on the weekends.
Council member Pazan (Finance) – The next Finance Committee meeting will be October 16th at 6:45 p.m.
Council member Knapp (Building) – The Building Department continues to be busy. Numbers of permits are very similar to those of last year. A survey from the Library was reviewed wherein students were asked what would get them to attend the Library more often. Some of the findings were more comfortable seating, interesting events and better evening hours on school nights. There are a total of 9,451 patrons registered at the Library with 105 registering in July and August.
Council member Surrago (Public Works) – Reported that the Bergen Line Train Station has a new pilot recycling container on the platform. It is hoped additional revenue will be received as a result of the additional recycling as well as the opportunity for advertising on the outside of the container.
Council member O’Hagan (Public Safety) - The County and Council have had their final walk-through for the light at Maple and Glen Avenues. There has been nothing but positive remarks on the light.

Doris Ciaramella – 15 Austin Place – Mrs. Ciaramella commented that Touch of Glass is going out of business due to retirement and The Hair Station has been in business for 30 years. Mrs. Ciaramella commented she has received comments from residents hoping the Borough will try and curb any future projects that will impact the borough’s budget. Mrs. Ciaramella also asked if it would be possible to get a figure of how many teachers/administrators live in town.
