In addition, a copy of this notice is and has been available to the public and is on file in the office of the Municipal Clerk.

WHERES, the Department of Public Works received bids on July 6, 2004 for the five year lease/purchase of a Jacobson Mower, that was approved in the 2004 Municipal Budget; and
WHEREAS, the low bidder was the Wilfred MacDonald Co. of South Hackensack, New Jersey that bid the sum of $15,806.07 per year for five years, and the bid award has been recommended by the Director of Public Works; now therefore

RESOLUTION APPROVING PAVING CONTRACT FOR RADBURN ROAD
WHEREAS, the Borough of Glen Rock needs to find a qualified paving company to pave Radburn Road and complete the drainage project started in the fall of 2003; and
WHEREAS, the Director of Public Works has recommended hiring Tilcon New York Inc. of West Nyack, New York, the paving contractor under contract to perform paving by Bergen County, having just successfully paved portions of Prospect Street and Rock Road in Glen Rock; and
WHEREAS, the Local Public Contracts Law allows municipalities to utilize bids from other governmental agencies, and the Bergen County Supervisor of Roads has provided us with the Tilcon contract number for 2004, 04-00282 dated March 24, 2004, and the Borough has received the attached proposal from Tilcon New York, Inc.; now therefore
BE IT RESOLVED, that the Borough Council hereby approves a contract with Tilcon New York Inc. to pave Radburn Road for an amount not to exceed $34,400, subject to certification of funds by the CFO.

RESOLUTION APPROVING AGREEMENT WITH ENGINEERING CONSULTANTS
WHEREAS, the Borough of Glen Rock is interested in hiring new engineering consultants to serve the Governing Body, Planning Board, Board of Adjustment and other governmental services for the Borough starting August 1, 2004; and
WHEREAS, the Mayor and Council have chosen Vollmer Associates, LLP, of Rochelle Park, New Jersey as the Borough’s new engineering consultants after a thorough series of interviews and background checks, including their extensive experience in serving other New Jersey municipalities as municipal engineers; and
WHEREAS, engineering consulting services are a professional service exempt from public bidding, but notice of this resolution must be sent to a legal newspaper as required by the Local Public Contracts Law; now therefore
BE IT RESOLVED, by the Borough Council of Glen Rock, that the attached agreement with Vollmer Associates, LLP is hereby approved, and the Mayor and Clerk are authorized to sign and attest the agreement subject to approval by the Borough Attorney and certification of funds by the CFO.

RESOLUTION AUTHORIZING EXECUTION OF PBA CONTRACT
WHEREAS, Borough of Glen Rock and PBA officials have successfully negotiated a labor agreement to cover the period January 1, 2004 through December 31, 2006, with both sides signing a memorandum of agreement subject to ratification by both the Borough Council and PBA membership; and
WHEREAS, this contract was arrived at after a long series of negotiating sessions that started in the summer of 2003 and concluded in June, 2004, with the memorandum of agreement recommended by the Borough’s Labor Counsel and Borough Administrator; now therefore
BE IT RESOLVED, by the Borough Council of Glen Rock, that the Mayor and Borough Clerk are hereby authorized to sign and attest a labor agreement with PBA Local No. 110 for the years 2004, 2005 and 2006, subject to approval by the Labor Counsel and Benefits Coordinator.

AN ORDINANCE TO AMEND CHAPTER 144 OF THE REVISED GENERAL ORDINANCES
OF THE BOROUGH OF GLEN ROCK, 1971 AS AMENDED
ENTITLED “MASSAGE PARLORS; BEING A ORDINANCE ESTABLISHING
A UNIFORM SET OF PROCEDURES FOR ADMINISTERING THE
ISSUANCE, RENEWAL AND REVOCATION OF LICENSES WITHIN
THE BOROUGH; TO PROVIDE FOR THE LICENSING OF
MASSAGE AND SOMATIC THERAPISTS
BE IT ORDAINED by the Mayor and Council of the Borough of Glen Rock, County of Bergen, State of New Jersey, as follows:
Section 1. Chapter 144 of the Revised General Ordinances of the Borough of Glen
Rock, 1971, as amended, entitled “Massage Parlors”, is hereby deleted in its entirety and replace with the following:
Chapter 144
Massage and Somatic Therapy
144-1. Declaration of Policy.
It is hereby declared that the business of operating a massage business, as defined in this article, is a business affecting the public health, safety and general welfare.
144-2. Definitions.
As used in the Article, the following terms shall have the meanings indicated:
A. MASSAGE and /or SOMATIC THERAPIES- Any system or activity of structured touch which includes, but is not limited to holding, applying pressure, stroking, kneading, positioning and mobilizing soft tissue of the body by manual techniques and the use of visual, kinesthetic, auditory and palpating skills to access the body for purposes of applying therapeutic massage, bodywork or somatic principles. Such application(s) may include by are not limited to, the use of therapies such as heliotherapy or hydrotherapy, the use of moist hot and cold external applications, external application of herbal or topical preparations not classified as prescription drugs, analysis of posture, movement and neural myofacial education and education in self-care and stress management. This definition shall not include the providing of chiropractic and medical services by a licensed professional.
B. MASSAGE and/or SOMATIC THERAPIST- A person who practices or administers massage and/or somatic therapy for any form of consideration. Massage and/or somatic therapist shall not diagnose or treat classified diseases, nor practice spinal or other joint therapy.
C. MASSAGE and /or SOMATIC THERAPY ESTABLISHMENT OR BUSINESS - Any establishment or operation wherein a massage/and or somatic therapy is administered or is permitted to be administered, when such massage and/or somatic therapy is administered for any form of consideration.
D. MASSAGE, when used throughout this Ordinance, shall mean singly or any combination of MASSAGE, SOMATIC THERAPY or ORIENTAL MASSAGE.
144-3. License Required.
A. No person shall be engaged or employed in the Borough as a massage and or therapist (for which any form of compensation is charged or accepted) without being accepted certified according to the standards of the Law and Public Safety Division of Consumer Affairs, New Jersey Board of Nursing Massage, Bodywork and Somatic Therapy Examining Committee. The Certification is personal and shall not be construed to grant a certificate of occupancy or approval for the use of any premises or location for the purposes of providing massage.
B. The licensee shall provide the following:
i. Proof the applicant is at least 18 years of age.
ii. A completed application form, to be provided by the Borough Clerk which requires, among other things, a history of prior residence for the preceding three (3) years and employment history for the preceding the (10) years; the application shall require that each applicant acknowledge that “it is unlawful for anyone to make a false statement on this application, and discovery of a false statement shall constitute grounds for denial or revocation of this permit”.
iii. Authorization for the Borough Police Department to secure a finger print record and background check.
iv. Certification from a duly licensed physician of the State of New Jersey stating that the applicant is free from contagious and communicable diseases, including a negative tuberculin screen dated within one (1) year of the application.
v. Certification issued by the New Jersey Law and Public Safety Division of Consumer Affairs, New Jersey Board of Nursing Massage, Bodywork and Somatic Therapy Examining Committee.
vi. Notarized statement that the applicant has not, within the preceding five (5) years, been convicted, pleaded nolo contendere or suffered a forfeiture on any criminal offense or on a charge of violating any provisions included in N.J.S.A. 2C:34-12 et seq. and/or N.J.S.A. 2C:14-2, as amended, which laws relate to indecency, obscenity and sexual offenses, or similar charges of violating this article or similar ordinances in any other jurisdiction.
vii. Proof of malpractice insurance in the amount not less than $100,000.
C. The license shall be valid for a period of one (1) year. It may be renewed upon the filing of a renewal application and submission of a certification from a duly licensed physician of the State of New Jersey stating that the applicant is free from contagious and communicable diseases, including a negative tuberculin screen, dated within one (1) year of the application. A fingerprint check shall not be required when obtaining a renewal license.
144-4. Requirements for establishment licensor; insurance; terms of license.
A. Each applicant for a massage establishment license shall set forth on forms provided by the Borough Clerk, the name and address of the applicant and all former addresses for a period of three (3) years prior to making the application, and the address of the premises to be used in the massage business as well as an approved zoning certificate of approval issued by the zoning officer of the Borough of Glen Rock.
B. The premises shall conform to the following:
i. No massage establishment shall begin operations until the Building Department has issued a Certificate of Occupancy pursuant to §230-94 covering the facility to be occupied by the applicant and meet all New Jersey Uniform Construction Code Requirements.
ii. Each massage business shall be equipped with a toilet and lavatory facilities for personnel. Each operating area shall be equipped with a hand lavatory.
iii. Compliance with all other pertinent building zoning and land use regulations of the Borough.
144-5. Sanitation and Hygiene
i. All tables, tubs, shower stalls and floors, except reception and administrative areas shall be made of non-porous material which may readily be disinfected.
ii. Closed containers shall be provided for wet towels and waste materials.
iii. All equipment, shower stalls, toilets, lavatories and any other such accouterments of the establishment shall be regularly treated with disinfectants and shall be maintained in a clean and sanitary condition at all times.
iv. No massage business shall knowingly serve any patron infected with any fungus or other skin infection, nor shall service be performed on any patron exhibiting skin inflammation or eruptions unless a duly licensed physician has certified that person may be safely served.
v. All towels, tissues, sheets or other coverings shall be used singularly for each patron and discarded for laundry or disposal immediately after use.
vi. Nondisposable tools of the trade shall be disinfected after use upon on patron.
114-6. Sleeping Quarters.
No part of any quarters of any massage establishment shall be used for or connected with any bedroom or sleeping quarters, nor shall any person sleep in such massage business except for limited periods incidental to and directly related to a massage. This provision shall not preclude the location of a massage business as a separate quarter of a building housing other business or domiciles.
114-7. Fees.
The license fee shall be as provided in Chapter 101, Fees.
114-8. License term.
All licenses issued pursuant to this article shall expire at the end of the calendar year in which said license was issued. In the event that the issuance is made for a part of a calendar year, the full license fee is required without any prorating.
114-9. Enforcement.
1. Prior to initial opening of an establishment, the Building Department shall be responsible for determining that the premises have been constructed according to applicable codes. Further, they shall verify that all masseuses have the required licenses or certifications and those such licenses are prominently displayed.
2. In existing establishments, the Borough Fire Inspector shall verify that all required licenses and certifications are displayed, and that the credentials of all Masseuses employed by the establishment are properly displayed. Any unauthorized modifications to the building and/or the lack of proper certification of Masseuses shall be reported to the Glen Rock Police Department and the Building Code Enforcement Bureau.
114.10. Revocation of license.
The conviction of any applicant or licensee of any criminal offense related to the licensee’s business, or any sex related offense, shall constitute a forfeiture of his or her license and said license shall be immediately revoked. The conviction of any applicant or licensee of any sanitary code violation may result in forfeiture of his or her license and said license may be deemed revoked.”
Section II. VALIDITY_SEVERABILITY If the provisions of any section, subsection, paragraph, subdivision, or clause of this Ordinance shall be held invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this Ordinance but such judgment shall be confined in its operation to the section, paragraph, subdivision or clause directly involved in the controversy in which said judgment shall have been rendered.
Section III. All Ordinances or parts of Ordinances inconsistent with the provisions hereof are hereby repealed.
Section IV. This Ordinance shall take effect upon passage as required by law.

VIOLATIONS FOR EMPLOYEE PARKING
BE IT ORDAINED by the Borough Council, the Borough of Glen Rock, County of Bergen, State of New Jersey, as follows:
Section I Chapter 150, of the Revised General Ordinances of the Borough of Glen Rock 1971, as amended, entitled "Parking" is hereby amended as follows:
Section 150-7 - Employee Parking, Subsection 5(a) - violations, is hereby amended by adding thereto a new section “v” to read as follows:
“v. Any employee who shall fail to park his/her/their vehicle in the designated employee parking areas as set forth in Schedule “A” as required herein shall be punished by fine, upon conviction, not less than $50 nor greater than $250 per offense”.
Section II. VALIDITY-SEVERABILITY If the provisions of any section, subsection, paragraph, subdivision, or clause of this Ordinance shall be held invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this Ordinance but such judgment shall be confined in its operation to the section, paragraph, subdivision or clause directly involved in the controversy in which said judgment shall have been rendered.

BE IT ORDAINED by the Borough Council, the Borough of Glen Rock, County of Bergen, State of New Jersey, as follows:
Section I That there is hereby established salary and wages for the classification of certain employees herein below set forth:

Section IV The amount to be paid to each officer or employee within the salary and wage range shall be fixed from time to time by resolution of the Mayor and Council.
Section V In addition to the salary ranges indicated above, longevity pay will be given to full-time Police Employees as specified in the contract.
Section VI The provisions of any ordinance or ordinances inconsistent with the provisions hereof are hereby expressly repealed.
Section VII Where labor contract prevails, terms and conditions of the contract shall supersede this ordinance.

AN ORDINANCE TO AMEND CHAPTER 230 OF THE
REVISED GENERAL ORDINANCES OF THE
BOROUGH OF GLEN ROCK, 1971 ENTITLED “ZONING”
BEING AN ORDINANCE ESTABLISHING A UNIFORM
SET OF ZONING REQUIREMENTS; TO MODIFY CONDITIONS
FOR THE CONSTRUCTION OF ACCESSORY BUILDINGS
BE IT ORDAINED by the Borough Council, the Borough of Glen Rock, County of Bergen, State of New Jersey, as follows:
Section I Chapter 230 of the Revised General Ordinances of the Borough of Glen Rock 1971, as amended, being an Ordinance entitled "Zoning" is hereby amended as to the following section(s):
(1) Section 230-14 entitled “Accessory Buildings” is hereby amended by deleting Subsection A (2) in its entirety to be replaced with the following:
“(2) They shall be at least ten (10) feet from any principal building situated on the same lot or on an adjoining lot and at least five (5) feet from any other accessory building on the same lot.”
Section II. VALIDITY_SEVERABILITY If the provisions of any section, subsection, paragraph, subdivision, or clause of this Ordinance shall be held invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this Ordinance but such judgment shall be confined in its operation to the section, paragraph, subdivision or clause directly involved in the controversy in which said judgment shall have been rendered.
Section III All Ordinances or parts of Ordinances inconsistent with the provisions hereof are hereby repealed.
Section IV This Ordinance shall take effect upon passage as required by law.

Heretofore introduced and does now pass on first reading, and that the said Ordinance be further considered for final passage at a meeting to be held on August 25, 2004 at 8:00 p.m., or as soon thereafter as the matter can be reached, at the Municipal Building in the Borough of Glen Rock, and that at such time and place all persons interested be given an opportunity to be heard concerning said ordinance, and that the Borough Clerk is hereby authorized and directed to publish said ordinance in the Bergen Record according to law with a notice of its introduction and passage on first reading and of the time and place when and where said ordinance will be further considered for final passage.

ORDINANCE NO. 1481
AN ORDINANCE TO AMEND CHAPTER 32 OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF GLEN ROCK 1971, AS AMENDED, ENTITLED “PARKS AND RECREATION, DIVISION OF,” BEING AN ORDINANCE AUTHORIZING THE ESTABLISHMENT OF FEES FOR THE USE OF MUNICIPAL FACILITIES AND RECREATIONAL PROGRAMS
BE IT ORDAINED by the Borough Council, the Borough of Glen Rock, County of Bergen, State of New Jersey, as follows:
Section 1. Chapter 32 of the Revised General Ordinances of the Borough of Glen Rock, 1971, as amended, being and Ordinance entitled “Parks and Recreation, Division of” is hereby amended as to the following subsections:
i. Article 32-3 entitled “Fees” is hereby deleted in its entirety and replaced with the following:
“32-3. Fees. Fees or charges for use of the swimming pool and tennis court facilities or the participation in Borough programs by bona fide residents of the Borough and their guests, shall be as provided by the Borough Council in Chapter 101, Fees.”
Section 2. Validity-Severability. If the provisions of any section, subsection, paragraph, subdivision, or clause of this Ordinance shall be adjudged invalid by a court of competent jurisdiction, such
judgment shall not affect or invalidate the remainder of this Ordinance, but such judgment shall be confined in its operation to the section, paragraph, subdivision or clause directly involved in the controversy in which said judgment shall have been rendered.
Section 3. All Ordinances or parts of Ordinances inconsistent with the provision hereof are hereby repealed.

AN ORDINANCE TO AMEND CHAPTER 101 OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF GLEN ROCK - 1971 AS AMENDED ENTITLED “FEES”; BEING AN ORDINANCE COVERING FEES CHARGED BY VARIOUS AGENCIES, BUREAUS AND DEPARTMENTS WITHIN THE BOROUGH OF GLEN ROCK; TO AMEND THE STANDARDS AND REGULATIONS RELATING THERETO.
BE IT ORDAINED by the Borough Council, the Borough of Glen Rock, County of Bergen, State of New Jersey, as follows:
Section I. Chapter 101 of the Revised General Ordinance - entitled “Fees” be and is hereby amended as follows:
i. Subsection 101-5 entitled “Pool and Tennis Badge” is hereby amended by deleting subsection C. Entitled “Participation Fee - Child Summer Program (Pool Shack)” in its entirety.
ii. There is added thereto a new subsection 101-17 entitled “Recreation Programs” to read as follows:
“ 101-17. Recreation Programs
In accordance with the provisions of Chapter 32, Parks and Recreation, Division
of, the following fees are established:
1. Participation Fee - Child Summer Program (Pool Shack)
A. Season Fee - $50 per child.
In no event, shall the total fee paid by any one resident family exceed the sum of $125 per season.”
Section II. AS AMENDED ENTITLED "VEHICLES AND TRAFFIC” BEING AN
ORDINANCE REGULATING THE PARKING AND OPERATION OF
VEHICLES WITHIN THE BOROUGH; TO ADD HANDICAP PARKING
WITHIN THE BOROUGH OWNED PROPERTY
BE IT ORDAINED by the Borough Council, the Borough of Glen Rock, County of
Bergen, State of New Jersey, as follows:
Section I Chapter 216 of the Revised General Ordinances of the Borough of Glen Rock 1971 as amended being an Ordinance entitled "Vehicles and Traffic" is hereby amended as to the following sections:
1. Section 216-35 entitled “ Schedule XII: Handicapped Parking” is hereby amended by adding to Subsection “A”, Off-street Parking, the following:
“(6) Front Municipal Building Parking Lot.
Section II. 6. MEETING OPEN TO THE PUBLIC: (Before speaking at the meeting, each one must state their name and address. 5 minute limit)
Mark Neuwirth – 49 Rock Road – Mr. Neuwirth asked what the benefit is for municipal employees to use the pool. Mr. Kendall replied that for many years the Council has allowed non-resident employees to join the pool at regular resident rates. Mr. Neuwirth stated it would be beneficial to the public if the meeting agendas were available a day before the meetings. Mr. Neuwirth asked if it were possible to e-mail agendas and meeting minutes to interested residents. Council member Jordan stated the Borough is currently working to have this capability on the website. Mr. Neuwirth asked if additional information could be supplied for the resolutions on the Consent Agenda. Mr. Neuwirth asked for details on the Police Contract. Mr. Kendall replied once a contract is signed those details will be available. Mr. Neuwirth asked the status of the DPW contract. Mr. Kendall replied he is uncertain due to missing information. Currently the DPW is waiting for a PBA settlement which once it comes Mr. Kendall is hoping they will start to meet in earnest. Mr. Neuwirth asked Mr. Kendall if we have the ability to locate a particular fixed asset. Mr. Kendall replied we do have that ability with a threshold of $1,000 being placed on fixed asset. Mr. Kendall added that this equipment is usually assigned to a department and not an individual.
Mary Henninger – Thornbury Avenue – Mrs. Henninger thanked the Council for the passing of Ordinance #1483 (handicapped parking). Mrs. Henninger asked when Rock Road will be
restriped. Mr. Kendall replied the stripping will be done by the contractor hopefully within the next week; however it is weather dependent. Mrs. Henninger asked about the Planning Board meeting pertaining to age-restricted housing. Council member Moore commented the Planning Board is looking into the possibility of designating locations for 55 and over housing.
Bill Brown – 675 Lincoln Avenue – Mr. Brown asked Mr. Kendall if the crosswalks would be luminescent. Mr. Kendall replied they would not be; however, they will be striped in white.
Jim Seaton – Ferndale Avenue – Mr. Seaton stated there are numerous untrimmed trees all over town.
Ralph Henninger – 108 Thornbury Avenue – Mr. Henninger suggested with the increased use of Lower Main Street Park a bench or two may be beneficial.
Paul Herrlett – 5 Franklin Place – Mr. Herrlett publicly thanked the Mayor for the endless hours of gardening he has done for the betterment of the Borough. It looks terrific.
