There will be a Public Meeting of the Mayor and Council of the Borough of Glen Rock on Wednesday, January 30, 2008, at 8:00 p.m. in the Council Chambers of the Municipal Building.

This meeting is called pursuant to the provisions of the Open Public Meeting Law. This Meeting was included in a list of meeting notices sent to the Bergen Record and advertised in said newspaper in January, posted on the bulletin board in the Municipal Building, and has remained continuously posted as the required notices under the Statue. In addition, a copy of this notice is and has been available to the public and is on file in the office of the Municipal Clerk.
In accordance with the New Jersey State Fire & Safety Code I call your attention to the lighted exit signs. In the event the alarm sounds, move in an orderly manner toward the exit nearest you and leave the building.

2. FLAG SALUTE/ANNOUNCEMENTS
Mr. Matteo’s 3rd grade Coleman class led the Council and audience in the flag salute.
Mayor van Keuren read the following proclamation:
Borough of Glen Rock
PROCLAMATION
Whereas, an understanding of the operations of local government is fundamental to becoming a useful citizen, and
Whereas, the acquisition of that understanding, if begun at a young age, makes the individual more valuable to the community and provides more opportunity to contribute to the community; and
Whereas we in borough government greatly appreciate those who step forward and ask to help in explaining what’s cooking at borough hall;
Now therefore, the Council and I proclaim that Mr. Matteo’s Coleman class of 2007-2008 is invited to appoint a rotating special liaison who will read about meetings of the Mayor and Council and report back to the class; further, the special liaison is invited to attend all meetings and provide a first hand, on the scene account of what’s cooking at borough hall. A seat will be reserved.
At this time, Mayor van Keuren had high words of praise for retiring Judge Thornwall. In his honor, a plaque was awarded honoring his service and the following proclamation was read:
PROCLAMATION
Whereas, as a refugee from Iowa, Paul W. Thornwall served Glen Rock as, first, Borough Prosecutor for seven years and then Municipal Judge for 28 years, and
Whereas for almost forty years Paul W. Thornwall has been an esteemed gentleman and neighbor to the residents of Glen Rock, and
Whereas for all that time he provided solid advice to many Mayors and countless Council members, armed only with enormous integrity, twinkling blue eyes and tales of the mischief that young boys in Iowa could get into,
Now Therefore,
I, John van Keuren, the most recent Mayor to enjoy his advice and sense of humor, declare the month of February 2008 to be Paul Wayne Thornwall month in Glen Rock, except for February 14th on which day he belongs entirely to Lynn.
Judge Thornwall thanked the Borough for allowing him to serve for so many years. The Thornwall Family was introduced and well represented.

2. Resolution for Recycling Tonnage Grant

WHEREAS, the Mandatory Source Separation and Recycling Act, P.L., 1987, c. 102, has established a recycling fund from which tonnage grant may be made to municipalities in order to encourage local source separation and recycling programs; and
WHEREAS, it is the intent and the spirit of the Mandatory Source Separation and Recycling Act to use the tonnage grants to develop new municipal recycling programs and to continue and to expand existing programs; and
WHEREAS, the New Jersey Department of Environmental Protection is promulgating recycling regulations to implement the Mandatory Source Separation and Recycling act; and
WHEREAS, the recycling regulations impose on municipalities certain requirements as a condition for applying for tonnage grants, including but not limited to, making and keeping accurate, verifiable records of materials collected and claimed by the municipality; and
WHEREAS, A resolution authorizing this municipality to apply for such tonnage grants for calendar year 2007will memorialize the commitment of this municipality to recycling and to indicate the assent of the Borough Council of Glen Rock to the efforts undertaken by the municipality and the requirements contained in the Recycling Act and recycling regulations; and
WHEREAS, such a resolution should designate the individual authorized to ensure the application is properly completed and timely filed.
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Glen Rock the Glen Rock hereby endorses the submission of the recycling tonnage grant application to the New Jersey Department of Environmental Protection and designates Craig Hemkes to ensure that the application is properly filed; and
BE IT FURTHER RESOLVED, that the monies received from the recycling tonnage grant be deposited in a dedicated recycling trust fund to be used solely for the purpose of recycling.

3. Resolution Authorizing the Acceptance of a Proposal From Data trace for the Borough to Provide Weekly Data Transmission of Tax Records.

A RESOLUTION AUTHORIZING THE ACCEPTANCE OF A PROPOSAL FROM DATA TRACE FOR THE BOROUGH OF GLEN ROCK TO PROVIDE A WEEKLY DATA TRANSMISSION OF TAX RECORDS.
WHEREAS, the Borough of Glen Rock has received a proposal from Data Trace, a tax search firm, requesting a data transmission once a week from the Glen Rock Tax Office for the tax records; and
WHEREAS, said request relates to information that is open to the public and would be available upon request; and
WHEREAS, Data Trace has proposed to pay the Borough of Glen Rock the sum of $500.00 per year for providing this service; and
WHEREAS, the aforesaid proposal has been reviewed and a recommendation has been received from the Municipal Tax Collector that the Borough accept the proposal;
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council that the proposal received from Data Trace to provide a data transmission once a week from the Glen Rock Tax Office of Borough tax records in return for payment of $500.00 per year be and hereby accepted.

4. MOTIONS
Departmental Reports
Council member O’Hagan (Public Safety) – Thanked Judge Thornwall for his service and positive representation of the Borough.
Council member Knapp (Building) – Reported that the estimated dollar amount of building done in the borough for 2007 was $20,276,137. Four new businesses will be moving into town.
Council member Pazan (Finance) – A second finance meeting was held working on the 2008 budget. Council member Pazan thanked Judge Thornwall for his part in bringing in revenue for the borough.
Council member Orseck (Parks and Recreation) – The Recreation Committee was present at Monday’s Council work session to discuss field usage. The turf field committee continues to meet and investigate possible options.
Council member Surrago (Public Works) – DPW placed five recycling containers within town. A new “salter” truck has finally arrived; initial delivery was expected prior to the Holidays.
Council member Arnao – Announced that our first revenue check of $16,000 from the Verizon cable franchise was received. Council meetings should begin to be televised on Channel 77 in approximately 60 days (Cablevision) with Verizon subscribers following later. The “Content Committee” is looking for volunteers to work on the content for Channel 77 and website.

Be It Resolved by the Borough Council of the Borough of Glen Rock that BOND ORDINANCE TO AUTHORIZE THE MAKING OF VARIOUS PUBLIC IMPROVEMENTS IN, BY AND FOR THE BOROUGH OF GLEN ROCK, IN THE COUNTY OF BERGEN, STATE OF NEW JERSEY, TO APPROPRIATE THE SUM OF $365,000 TO PAY THE COST THEREOF, TO APPROPRIATE A STATE GRANT, TO MAKE A DOWN PAYMENT, TO AUTHORIZE THE ISSUANCE OF BONDS TO FINANCE SUCH APPROPRIATION AND TO PROVIDE FOR THE ISSUANCE OF BOND ANTICIPATION NOTES IN ANTICIPATION OF THE ISSUANCE OF SUCH BONDS.

BOND ORDINANCE TO AUTHORIZE THE MAKING OF VARIOUS PUBLIC IMPROVEMENTS IN, BY AND FOR THE BOROUGH OF GLEN ROCK, IN THE COUNTY OF BERGEN, STATE OF NEW JERSEY, TO APPROPRIATE THE SUM OF $365,000 TO PAY THE COST THEREOF, TO APPROPRIATE A STATE GRANT, TO MAKE A DOWN PAYMENT, TO AUTHORIZE THE ISSUANCE OF BONDS TO FINANCE SUCH APPROPRIATION AND TO PROVIDE FOR THE ISSUANCE OF BOND ANTICIPATION NOTES IN ANTICIPATION OF THE ISSUANCE OF SUCH BONDS.

BE IT ORDAINED by the Borough Council of the Borough of Glen Rock, in the County of Bergen, State of New Jersey, as follows:
Section l. The Borough of Glen Rock, in the County of Bergen, State of New Jersey (the "Borough") is hereby authorized to make various public improvements in, by and for said Borough, as more particularly described in Section 4 hereof. The cost of the improvements includes all work, materials and appurtenances necessary and suitable therefore.
Section 2. There is hereby appropriated to the payment of the cost of making the improvements described in Sections l and 4 hereof (hereinafter referred to as "purposes"), the respective amounts of money hereinafter stated as the appropriation for said respective purposes. Said appropriation shall be met from the proceeds of the sale of the bonds authorized, and the down payment and the State grant appropriated, by this ordinance. Said improvements shall be made as general improvements and no part of the cost thereof shall be assessed against property specially benefited.
Section 3. It is hereby determined and stated that the making of such improvements is not a current expense of said Borough.
Section 4. The several purposes hereby authorized for the financing of which said obligations are to be issued are set forth in the following "Schedule of Improvements, Purposes and Amounts" which schedule also shows (l) the amount of the appropriation and the estimated cost of each such purpose, and (2) the amount of each sum which is to be provided by the State grant hereinafter appropriated, and (3) the amount of each sum which is to be provided by the down payment hereinafter appropriated to finance such purposes, and (4) the estimated maximum amount of bonds and notes to be issued for each such purpose, and (5) the period of usefulness of each such purpose, according to its reasonable life, computed from the date of said bonds:
SCHEDULE OF IMPROVEMENTS, PURPOSES AND AMOUNTS
A. Improvement of Cornwall Road - Phase II (from Garret Place to Radburn Road), including road reconstruction and resurfacing, and the making of curb, sidewalk and drainage improvements, where necessary. It is hereby determined and stated that said road being improved is of "Class B" or equivalent construction as defined in Section 22 of the Local Bond Law (Chapter 2 of Title 40A of the New Jersey Statutes Annotated, as amended; the ALocal Bond Law).

Section 5. The cost of such purposes, as hereinbefore stated, includes the aggregate amount of $125,000 which is estimated to be necessary to finance the cost of such purposes, including architect's fees, accounting, engineering and inspection costs, legal expenses and other expenses, including interest on such obligations to the extent permitted by Section 20 of the Local Bond Law.
Section 6. The sum of $150,000 received or to be received as a grant from the State of New Jersey Department of Transportation is hereby appropriated to the payment of the cost of the improvement of Cornwall Road authorized in Section 4.A hereof.
Section 7. It is hereby determined and stated that moneys exceeding $100,000, appropriated for down payments on capital improvements or for the capital improvement fund in budgets heretofore adopted for said Borough, are now available to finance said purposes. The sum of $100,000 is hereby appropriated from such moneys to the payment of the cost of said purposes.
Section 8. To finance said purposes, bonds of said Borough of an aggregate principal amount not exceeding $115,000 are hereby authorized to be issued pursuant to the Local Bond Law. Said bonds shall bear interest at a rate per annum as may be hereafter determined within the limitations prescribed by law. All matters with respect to said bonds not determined by this ordinance shall be determined by resolutions to be hereafter adopted.
Section 9. To finance said purposes, bond anticipation notes of said Borough of an aggregate principal amount not exceeding $115,000 are hereby authorized to be issued pursuant to the Local Bond Law in anticipation of the issuance of said bonds. In the event that bonds are issued pursuant to this ordinance, the aggregate amount of notes hereby authorized to be issued shall be reduced by an amount equal to the principal amount of the bonds so issued. If the aggregate amount of outstanding bonds and notes issued pursuant to this ordinance shall at any time exceed the sum first mentioned in this section, the moneys raised by the issuance of said bonds shall, to not less than the amount of such excess, be applied to the payment of such notes then outstanding.
Section 10. Each bond anticipation note issued pursuant to this ordinance shall be dated on or about the date of its issuance and shall be payable not more than one year from its date, shall bear interest at a rate per annum as may be hereafter determined within the limitations prescribed by law and may be renewed from time to time pursuant to and within limitations prescribed by the Local Bond Law. Each of said bond anticipation notes shall be signed by the Mayor and by a financial officer and shall be under the seal of said Borough and attested by the Borough Clerk or Deputy Borough Clerk. Said officers are hereby authorized to execute said notes in such form as they may adopt in conformity with law. The power to determine any matters with respect to said notes not determined by this ordinance and also the power to sell said notes, is hereby delegated to the Chief Financial Officer who is hereby authorized to sell said notes either at one time or from time to time in the manner provided by law.
Section 11. It is hereby determined and declared that the average period of usefulness of said purposes, according to their reasonable lives, taking into consideration the respective amounts of bonds or notes authorized for said purposes, is a period of 14.13 years computed from the date of said bonds.
Section 12. It is hereby determined and stated that the Supplemental Debt Statement required by the Local Bond Law has been duly made and filed in the office of the Borough Clerk of said Borough, and that such statement so filed shows that the gross debt of said Borough, as defined in Section 43 of the Local Bond Law, is increased by this ordinance by $115,000 and that the issuance of the bonds and notes authorized by this ordinance will be within all debt limitations prescribed by said Local Bond Law.
Section 13. Any private contributions, any funds received from the County of Bergen, the State of New Jersey or any of their agencies or any funds received from the United States of America or any of its agencies in aid of such purposes (other than the State grant hereinbefore appropriated which shall be applied to the cost of such purposes, but shall not be applied to the payment of outstanding bond anticipation notes and the reduction of the amount of bonds authorized), shall be applied to the payment of the cost of such purposes, or, if bond anticipation notes have been issued, to the payment of the bond anticipation notes, and the amount of bonds authorized for such purposes shall be reduced accordingly.
Section 14. The Borough intends to issue the bonds or notes to finance the cost of the improvements described in Sections 1 and 4 of this bond ordinance. If the Borough incurs such costs prior to the issuance of the bonds or notes, the Borough hereby states its reasonable expectation to reimburse itself for such expenditures with the proceeds of such bonds or notes in the maximum principal amount of bonds or notes authorized by this bond ordinance.
Section 15. The full faith and credit of the Borough are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this ordinance. Said obligations shall be direct, unlimited and general obligations of the Borough, and the Borough shall levy ad valorem taxes upon all the taxable real property within the Borough for the payment of the principal of and interest on such bonds and notes, without limitation as to rate or amount.
Section 16. The capital budget is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency therewith and the resolutions promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director, Division of Local Government Services, is on file with the Borough Clerk and is available for public inspection.
Section 17. This ordinance shall take effect twenty days after the first publication thereof after final passage.
6. MEETING OPEN TO THE PUBLIC: (Before speaking at the meeting, each person must state their name and address. 5 minute limit)
Ayano Endo – 32 Thurston Terrace – (student) Ayano read a statement from her 3rd grade class stating they are currently studying local government and thanked the Council for allowing them to participate in tonight’s meeting.
Emily Schaefer – 47 Ridge Road – (student) – Emily commented on the issue of the use of pesticides on lawns and the harm to the environment.
Lindsey Vachon – 90 Hillman Avenue – (student) – Lindsey commented on the issue of “turfing” the fields at Faber. This would allow games to be played in inclement weather as well as provide a sledding hill in the winter. Lindsey also believes, in the long run, it would save money for the town as turf is easier and less expensive to take care of.
Jada Huang – 77 Ellsworth Terrace – (student) – Jada commented that the parks and school yards are not as clean as they should be for two reasons; cigarette butts and dog waste. Jada asked the Council to request that the Police enforce the picking up of this waste. Jada also suggested a volunteer group being established to clean up around Glen Rock once a month.
Elaine Howe – 808 Maple Avenue – Ms. Howe commented on the proposed tree ordinance and believes it is a good idea, within reason.
